So now its the bank decided to take over possession of the flat, and I cant do anything. I just moved in on 9th May and received a notice of eviction from court on 24th May saying the eviction will take place on 12th June. We signed a 12months contract with an estate agent, what is my legal position in this situation, can I suspend the warrant and postpone the date for eviction? Tried to contact the landlord, his phone was off and the estate agent is very slow in dealing with this incident.

First of all, ring your local council. Tell them that it’s through no fault of your own that you are being evicted and get them to put your name down on the list of homeless people. Keep getting on the estate agents back, they might be able to find another property for you.
Don’t give up and keep phoning. You might think you’re being annoying but they are more likely to sort out your issue if you keep reminding them of it. Good luck.

You are in a bad situation and you may need an attorney to help you out. Before that I would try to go in and personally talk to someone at the bank and ask them what you can do. They might let you stay month to month and see if a new buyer wants you as a tenant. They might also find a way that you could buy the property from the bank after they foreclose. Ask the landlord for your deposit back, do not pay June’s rent unless you have everything worked out with the landlord and are sure the bank will not evict. Maybe you can offer to pay your rent to the bank if they will let you stay. Good Luck!
You can only delay the eviction. Legally you are entitled to 30 days. That landlord had to have known this was already in the works and rented to you anyway. For sure you are entitled to any deposit back. If you can afford to see a lawyer I’d sue that landlord for relocation fees.
Make a homeless application with your local authority. You can suspend the warrant but it will only buy you days and if the warrant is in landlords name…..which it should be it would have to be him that applies for the suspension
