My ex has agreed to transfer our home currently in both our names into my name only. How do we do this?? I do not want to get a solicitor or conveyancer involved (as I do not have the money). Can anyone help me with the process? There is currently a mortgage on the house, but I would like to refinance it into my name only. Any help/advice is appreciated. Thanks……

Hi stressed,
I live in Vic OZ,
I am currently going through the same thing,( the refinancing bit)
and talking yesterday with my solicitor it seems that if you are related e.g husband and wife, father daughter …it does not cost much to transfer the name on a mortgage.
It costs more if you are not related because then you have to pay stamp duty…..which sucks, I know
The main problem lies in the fact that you want “to refinance it into your name only”….the mortgage lender needs to be notified of this intent…so they can ascertain whether you can meet the repayments ( and I am damn sure they will want to do this)…..or else they could say you have broken the contract and you could forfeit your loan.
I am sure if you approached your lender (even anonymously via phone) they would give you the best case scenarios that you can choose from.
Good luck…..I hope it works out for you …..divorce/separation is a crappy place to be much less going through this as well!
