Can the agent keep my deposit when they change thier minds not to rent the house to us? What should we do?

We went to a estate agent to rent a house, we paid the deposit after the viewing, the agent did not say if there is any requirement before this.

Two days after, they ask for a guarantor.We are international student,so we asked if our parent could be guarantor, they agreed.But one day after,they said landlord requires the guarantor to be UK base, and they keep adding terms to qualify as a guarantor, at last, we can’t find the people they would be recognized as UK base guarantor, so we ask if we can pay 6 month rent in advance, they agreed

We went to the agency to make the payment, they started to question us about the numbers of tenant would be in the property, after a serious of argue, they said they do not want to rent the property to us, just on the day before we prepare to move in, and was also the day before we need to move out our current place.Now they said because we waste their time, they may not return the deposit to us. Do they really have the right to keep our deposit?

    No. Go the office and make a scene. They will give you the money just to go away.

    Tell us who they are a nd we will sort them out for you.

    NO demand your deposit back and also tell them you are going to claim of them for breach of contract

    no absolutely not. either they are a dodgy agent or they are trying to take advantage of the fact ur foreign. go back to them and ask for it back or write to them. if u have enough money you could ask a solicitor to write them a letter that may get some action, otherwise go to your local citizens advice bureau (look up in the telephone book theres one in most towns) and they will be able to advise u what to do. good luck.

    If the person is a licensed Realtor you need to look up the local board of Realtors and report them. the board of Realtors will make things right. if the person in question does not comply with the local board then the local board will revoke the real estate license of the person who did this to you.

    First of all it seems to me that they wasted your time as well. They should have been clear from the start as of what the requirements were for renting this property, verified if you qualified and then taken a deposit, not the other way around.

    They have to give it back BIG time.

    Law changed in April this year. You are now protected

    They can t keep playing the crook like they ve been doing for years.

    Tell them you will be going to the small claims court. Also tell them that you are sure you will win your case and the judgement against them would do great harm to their business.

    no they can not keep your deposit.its the law.go get your money.and dont leave without it.cause a scene.best of luck.

    Actually, the return of the deposit depends.. Did you sign anything before giving them the deposit? Did they tell you No before or after the lease was signed?

    Sorry, it sucks sounds like a scam, but that is why you must always deal in writing. Contact your local housing authority.

    No they cannot. Go to them and demand your money back with 10% interest added for every month they withold. Put your demand in writing and hand them the letter. Sit in their office until they pay you and tell every person that walks in why you are there. Contact Citizens Advice for more help.

    You are entitled to all your money back and if they refuse, you should report them to your local Trading Standards Office. These people will tell you what your rights are and explain what you should now do.
    If you need any further help, go to your local citizens advice bureau. Their advice is free,
    I do hope you have some luck soon. Not all Estate Agents or Letting Agents act like this, you have just come across a bad one but all is not lost, you will be entitled to a refund!

    No they cannot take your deposit. If they wont rent the property to you, they have nothing to take the money for. Kick up such a stink in that office and refuse to leave until you get your money back. Tell them, also, you will go to Trading Standards.

    If the landlord changed his mind and didn’t want you to move in then you will get your deposit back. If you change your mind or fail the references yes the agent can keep the deposit as the refernces has cost the agent, and lost applicants to view the property to get the landlord a let and also marketing fees are involved!!

    No- it is a deposit. Get a few of you together and fill up their office until they hand it over.
    Might be worth visiting your local Citizens Advice Bureau (free) beforehand so that you can get information to read out to the agents.
